Terms of Service (“Terms”) constitute a legally binding agreement between KiddieCove (“we,” “our,” “us,” or “KiddieCove”) and you, whether you are a school, school administrator, teacher, parent, or guardian, regarding your use of the KiddieCove platform, including our website at kiddiecove.io and our mobile application (collectively, the “Service”).

Please read these Terms carefully before using the Service. By accessing or using KiddieCove, or by clicking “I Agree” during account setup, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

If you are accepting these Terms on behalf of a school or organisation, you represent that you have the authority to bind that organisation to these Terms.

Agreement Overview

KiddieCove provides schools in Pakistan with a cloud-based school management platform that includes student attendance tracking, parent-teacher communication, online fee collection via JazzCash and EasyPaisa, GPS-based school bus tracking, and child pickup and drop-off safety management.

These Terms govern your access to and use of that platform. They work alongside our Privacy Policy, which explains how we handle personal data, including student and child data. Both documents together form the complete legal agreement between you and KiddieCove.

Who These Terms Apply To

These Terms apply to all users of the KiddieCove Service:

Schools and School Organisations: Private schools, Montessori institutions, daycare centres, and any educational institution that subscribes to KiddieCove as an organisation. The school is the primary account holder and data controller for its students.

School Administrators: The designated staff member(s) who manage the school’s KiddieCove account, configure the platform, and manage user access.

Teachers: Staff members granted access to the KiddieCove platform by the school administrator to manage attendance, communicate with parents, and access class-level data.

Parents and Guardians: Individuals who access the KiddieCove parent portal or mobile application to view their child’s school information, communicate with teachers, receive safety alerts, and pay school fees.

Each user type has different permissions and responsibilities within the platform, as described in the User Responsibilities section below.

The KiddieCove Terms of Service

KiddieCove provides the following core capabilities as part of the Service, subject to your subscription plan:

The specific features available to your account depend on your subscription plan. KiddieCove reserves the right to add, modify, or remove features with reasonable notice to school subscribers.

School Accounts: Subscription and Access

Subscription Plans and Billing

KiddieCove is a Software-as-a-Service (SaaS) platform offered to schools on a subscription basis. By subscribing, the school agrees to pay the fees applicable to the selected plan as published on our pricing page or as agreed in a written proposal.

Free Trial

KiddieCove may offer a free trial period to new school subscribers. During the free trial:

KiddieCove’s general policy is that subscription fees are non-refundable once a billing period has commenced, as the Service is immediately available upon payment.

KiddieCove reserves the right to suspend or terminate any account found to be in violation of this Acceptable Use Policy without prior notice in cases where the violation poses a security risk or harm to other users.

Intellectual Property

KiddieCove’s property: The KiddieCove platform, including its software, design, user interface, features, functionality, trademarks, logos, and all content created by KiddieCove, is owned by KiddieCove and is protected by Pakistani intellectual property laws. These Terms do not grant you any ownership rights in the platform.

Your licence to use the Service: KiddieCove grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service strictly in accordance with these Terms and for the purpose of school management. This licence ends when your subscription or access is terminated.

Your data: You retain full ownership of all data you input into the KiddieCove platform including student records, attendance data, fee records, and communication content. KiddieCove does not claim any ownership over your school’s or students’ data.

Feedback: If you provide feedback, suggestions, or ideas to KiddieCove about the Service, you grant KiddieCove the right to use that feedback without obligation or compensation to you. We appreciate feedback and use it to improve the platform.

Data Ownership and Privacy

Schools are the data controllers for their students’ and staff’s personal data entered into KiddieCove. KiddieCove acts as a data processor on behalf of schools.

Service Availability and Support

Uptime commitment: KiddieCove aims to maintain 99% platform availability, excluding scheduled maintenance. We will provide advance notice of scheduled maintenance that is likely to affect availability during school hours.

Unplanned downtime: In the event of unplanned outages, KiddieCove will communicate status updates via our website and notify school administrators by email. We will work to restore service as quickly as possible.

Support: KiddieCove provides customer support to school administrators via:

Support is provided in English and Urdu. KiddieCove aims to respond to support requests within 1 business day.

No guarantee of uninterrupted service: While we strive for high availability, KiddieCove does not guarantee that the Service will be uninterrupted, error-free, or free from security vulnerabilities. The Service is provided on an “as is” basis, subject to the limitations described below.

Limitation of Liability

To the fullest extent permitted by Pakistani law:

KiddieCove is not liable for:

Cap on liability: KiddieCove’s total cumulative liability to a school subscriber for any claims arising from these Terms or use of the Service shall not exceed the total subscription fees paid by that school in the 3 months immediately preceding the event giving rise to the claim.

Child safety features: KiddieCove’s pickup safety and GPS tracking features are tools to assist schools in managing student safety. They are not a substitute for appropriate physical security measures, trained staff, and school safety protocols. KiddieCove does not accept liability for child safety incidents that occur at schools or during transport, whether or not the platform was in use at the time.

Nothing in these Terms limits liability that cannot be excluded by law, including liability for fraud or death or personal injury caused by negligence.

Indemnification

You agree to indemnify, defend, and hold harmless KiddieCove, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

Third-Party Services

KiddieCove integrates with third-party services to deliver certain features:

JazzCash and EasyPaisa: Payment processing. Their use is governed by their respective terms of service and State Bank of Pakistan (SBP) regulations. KiddieCove is not responsible for payment processing errors, delays, or failures caused by these providers.

GPS Hardware Providers: School bus tracking relies on GPS hardware installed on school vehicles. The accuracy and reliability of GPS data depends on the hardware and network conditions. KiddieCove is not responsible for GPS hardware faults or mobile network outages that affect tracking accuracy.

SMS and Push Notification Providers: Delivery of notifications to parents and staff relies on third-party SMS gateways and mobile operating system push notification services. KiddieCove cannot guarantee delivery of time-sensitive notifications if these networks experience disruptions.

Links or integrations with third-party services do not constitute KiddieCove’s endorsement of those services. You access and use third-party services at your own risk under their terms.

Termination

Termination by you: Schools may cancel their subscription as described in the Subscription section above. Individual users (teachers, parents) may request account deletion by emailing [email protected] or through account settings.

Termination by KiddieCove: KiddieCove may suspend or terminate your access to the Service immediately and without prior notice if:

Effect of termination: Upon termination, your right to access the Service ends immediately. For school subscriptions, data retention and deletion follows the schedule described in the Data Ownership section and our Privacy Policy. KiddieCove is not liable for loss of data following termination.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising out of or relating to these Terms or the Service shall be subject to the jurisdiction of the courts of Lahore, Pakistan.

We encourage resolution without litigation. If you have a dispute with KiddieCove, please contact us first at [email protected]. We commit to responding within 5 business days and attempting to resolve the issue in good faith before any formal proceedings are initiated.

Changes to These Terms

KiddieCove may update these Terms from time to time. When we do:

Continued use of the Service after the effective date of updated Terms constitutes your acceptance of the revised Terms. If you do not agree to updated Terms, you must stop using the Service and cancel your subscription before the effective date.

Frequently Asked Questions About KiddieCove Terms

Who owns the student data entered into KiddieCove?

The school owns all student data entered into KiddieCove. KiddieCove acts as a data processor on behalf of the school we handle the data only to deliver the platform’s features and never for our own commercial purposes. When a school ends its subscription, all data is available for export for 90 days, then permanently deleted.

Can KiddieCove use our school’s data for advertising or marketing?

No. KiddieCove does not use school data, student data, or parent data for advertising, marketing, or profiling purposes whether for our own campaigns or for third parties. Our business model is subscription-based; we have no commercial interest in monetising your data.

What happens if KiddieCove experiences downtime during school hours?

KiddieCove aims for 99% uptime and will notify school administrators in advance of any scheduled maintenance. For unplanned outages, we communicate status updates via our website and email. If an outage is verified to have lasted more than 72 consecutive hours, schools may be eligible for a service credit contact [email protected] within 14 days of the incident.

Can a school get a refund if they are not satisfied?

KiddieCove’s subscription fees are generally non-refundable once a billing period has started, because the Service is available immediately upon payment. We do offer a free trial so schools can evaluate the platform fully before committing. If you experience a technical fault that materially prevented use of the Service, contact [email protected] within 14 days and we will review your case.

Can a teacher access student data from other classes?

No. KiddieCove uses role-based access control (RBAC). Teachers can only access data for their assigned classes and students. School administrators configure these permissions. If you believe a teacher has accessed data outside their permitted scope, please contact your school administrator or email [email protected] immediately.

What laws govern KiddieCove’s Terms of Service?

These Terms are governed by the laws of Pakistan, including the Prevention of Electronic Crimes Act (PECA) 2016 and the Contract Act 1872. Disputes are subject to the jurisdiction of the courts of Lahore, Pakistan. KiddieCove also aligns with internationally recognised data protection principles as part of its commitment to responsible data handling.

How do I cancel a KiddieCove school subscription?

The school administrator should email [email protected] at least 14 days before the renewal date requesting cancellation. We will confirm the cancellation and advise on data export options. The school retains full access to the platform until the end of the paid billing period.

Does the free trial automatically convert to a paid subscription?

No. KiddieCove’s free trial does not automatically convert to a paid plan or charge your account. At the end of the trial, the account is suspended unless the school actively chooses to subscribe. Your data is retained for 30 days after trial expiry, giving you time to subscribe and pick up where you left off.
